PCLOB Advice Function
The PCLOB provides advice to the President and executive branch agencies to ensure that privacy and civil liberties are appropriately considered in the development and implementation of legislation, regulations, and policies related to efforts to protect the nation from terrorism.
Executive Order 12333
Since 2016, the Board has provided advice on significant issuances of and revisions to Intelligence Community elements’ Attorney General Guidelines governing the handling of U.S.-person information collected under Executive Order 12333.
Executive Order 14086
Following the signing of Executive Order 14086 ("Enhancing Safeguards for United States Signals Intelligence Activities") in October 2022, the Office of the Director of National Intelligence (ODNI) sought the PCLOB’s advice on new procedures developed by each of the intelligence agencies to provide enhanced privacy and civil liberties safeguards covering cross-border data flows under the new EU/US Data Privacy Framework. The PCLOB provided its advice and recommendations on these draft procedures in the spring of 2023.
The Department of Justice also consulted with the Board regarding the appointment of judges to serve on the Data Protection Review Court (DPRC) created by EO 14086. The PCLOB will continue to provide advice as requested on the appointment of future DPRC judges.
